Handling the Issues That Matter to You
If you and your spouse have no children and little property, an uncontested divorce can be a relatively simple process, although you should still get the advice of an attorney to make sure you aren't giving up important rights.
Divorce can get more complicated when any of the following elements are involved:
- Child custody and parenting time (visitation): If you have children, you will be required to attend a court-approved parent education (COPE) class with your spouse. Before you can divorce, the court will need to approve a parenting plan that reflects the best interests of the children.
- Child support: The court needs an accurate account of each parent's income in order to calculate the appropriate payment under Oregon's child support formula.
- Spousal support: Depending on the length of the marriage, the age of the parties and other factors, one spouse may be required to pay the other compensatory, transitional or permanent spousal support, also known as alimony or spousal maintenance.
- Marital property division: Any real or personal property acquired or improved during the marriage is subject to division on the basis of principles of equity.
Helping You Make Informed Decisions
Divorce can be an emotionally difficult situation, and many people feel that their feelings about how things have gone wrong in the marriage justify a certain result.
It is important, however, to have realistic expectations going in to the divorce process. This can help you set priorities and avoid making a bad situation worse, especially if you have children. David will give you honest advice based on his experience with Oregon divorce cases.
David has the experience to help you resolve these issues, whether through negotiation, mediation or litigation. Contact him to discuss how he can help you through the divorce process.
